We understand the intricacies of regional shopping malls, neighborhood and community shopping centers, mixed-use properties, landmark urban properties, transit hubs, entertainment and lifestyle centers, hotels and resorts, middle and low income housing developments, and street retail locations. Our firm has negotiated all types of leases, including anchor store leases, junior anchor store leases, in-line mall store leases, restaurant leases, pad leases and ground leases, many of which are with national retailers. However, our flexible approach in working through deals also benefits owners leasing to “mom and pop” and start-up tenants who are looking for retail space to start a small business, often in developing cities and neighborhoods.
We represent many owners on a portfolio-wide basis. This allows us to assist them with establishing uniform leasing practices and procedures throughout their portfolios, enabling us to be more efficient and economical in our representation and to assist our clients in streamlining their internal lease administration functions. The breadth of our practice and the longevity of our relationships allow us to take a strategic approach to the leasing and development of all types of shopping centers and other retail projects.
Many of our clients consult us at the earliest stages of the development of a project, allowing us to negotiate the letters of intent for the anchor, major store, and other retail leases. We have extensive experience with all stages of the retail development process, whether for a major shopping center or a small retail or mixed use development, including drafting and negotiating reciprocal easement agreements, development agreements and construction agreements, and working with the developer’s lenders and partners in achieving financial objectives. Using this ground-up approach, we keep track all of the moving and interlocking pieces of a project to help our clients achieve their business goals.
In addition to our ownership representation, we also represent a variety of retail tenants, from small start up businesses, to restaurant chains, to national retailers. We aim to develop relationships with all tenant retail clients so we can assist them in achieving their growth and development objectives throughout the years. We have often represented retail tenants at their first location and maintain the leasing relationship as they grow into major national and regional retailers. Because of our extensive representation of both owners and tenants, we have developed and maintained relationships with retail counsel throughout the United States, facilitating and easing the leasing process and initiating beneficial long term relationships on both sides of the transaction.
